You might have a point in that the law will not cover all of the cases of people smoking in a car with a person under the age of 16. However, you neglect a various obvious scenario that this law was most likely intended to address: a situation where a police officer spots someone smoking while driving in the presence of a child clearly under the age of 16 in the car. In that case, the law is clearly enforceable. Furthermore, it's just: second-hand smoke is extremely deadly, and there should be legal recourse of any parent who exposes their children to it.
